Why Work with Anantara Counsel

Structured Disclosure Process

Each engagement begins with a formal invention disclosure form. This organises technical details before any drafting begins, reducing iterations and keeping the engagement on schedule.

Thai Patent Act Expertise

Applications are drafted with a working knowledge of the Department of Intellectual Property's examination practice, reducing unnecessary back-and-forth with the patent office.

International Associate Network

For PCT national phase entries, work is coordinated with established associates in target jurisdictions. Clients receive single-point reporting rather than managing separate counsel in each country.

Fee and Deadline Planning

Patent prosecution involves a sequence of official fees and statutory deadlines spread over several years. Anantara Counsel maintains a forward-looking schedule and keeps clients informed in advance of each obligation.

Technical Sector Experience

The practice handles applications across mechanical, chemical, and electronic subject matter. Specifications are drafted with sufficient technical depth to support broad and defensible claim sets.

University and SME Focus

The service structure suits university technology transfer offices, research spin-outs, and small firms who need professional patent drafting without the overhead of a large IP firm relationship.

Frequently Asked Questions

What is the difference between a patent and a petty patent in Thailand?

Thailand's Patent Act provides for two categories of protection for technical inventions. A patent requires a higher inventive step and is examined substantively over a longer period, potentially giving protection for up to 20 years. A petty patent has a lower inventive step threshold, is registered more quickly, and protects for up to 10 years. The appropriate route depends on the nature of the invention and the applicant's commercial timeline.

How long does the Thai patent examination process typically take?

Once filed, a Thai patent application enters a publication period followed by substantive examination, which the applicant must request within five years. Examination at the Department of Intellectual Property can take several years beyond that, depending on subject matter and the examiner's workload. Total time from filing to grant commonly ranges from five to eight years for a standard patent, though this varies by technical field.

What does the patentability assessment engagement include?

The engagement starts with a structured invention disclosure form, which guides the inventor through a set of technical questions. Once completed, a prior art search is conducted across patent databases and scientific literature. The output is a written opinion addressing novelty, inventive step, and industrial applicability, together with observations on how the scope of any proposed claims might be positioned.

Can I file a PCT application if I already have a Thai application pending?

Yes. A PCT application can be filed within 12 months of the Thai priority application, claiming that priority date. This gives the applicant 30 months from the priority date before national phase entry decisions must be made, providing time to assess commercial prospects in different markets before committing to the cost of individual national filings.

Are official government fees included in the quoted service prices?

The quoted prices cover professional fees for drafting, filing, and routine prosecution work as described for each service. Official government fees — DIP filing fees, examination request fees, annual renewal fees, and international PCT fees — are charged separately at cost. A fee schedule is provided at the outset of each engagement so that total expected disbursements are visible.

What technical fields does Anantara Counsel handle?

The practice works across mechanical engineering, chemical processes and formulations, electronics and software-implemented inventions, and agricultural technology. Patent specifications in these fields require careful technical description alongside precise claim drafting, and the practice is equipped to handle both the legal and technical dimensions of such work.
